Iscar warrants its products to be free from defects in material and workmanship for a period of one year from original retail sale. This is in lieu of all other warranties, expressed or implied, including any warranty merchantability or fitness for a particular purpose. The sole and exclusive remedy of any purchaser (including, without limitation, the original purchaser and any remote purchaser) against Iscar shall be the repair, replacement or issuing of credit, at Iscar's discretion, without charge of such items of Iscar's manufacture that Iscar agrees are defective in as they do not reach a reasonable standard common in the trade. Purchaser agrees that no other remedy (including, without limitation, special, incidental or consequential damages for loss of profit or sales, injury to person or property or any other incidental or consequential loss) shall be available to him.
